The Department of Biocides
was established in 2 April, 2007
in the National Institute of Chemical Safety.
The activity of the Department is determined by Public Act No XXV of 2000 on Chemical Safety, by the Health Ministerial Decree No 44 of (27 Dec) 2000 on the detailed rules of certain procedures and activities related to dangerous substances and dangerous preparations, by the joint ministerial decree of the Minister of Health, Social and Family Affairs, the Minister of Agriculture and Rural Development and the Minister of Environment and Water No 38 of (7 July) 2003 on the conditions of producing and placing of biocidal products on the market, and by regulations of the EC related to the Directive 98/8/EC of the European Parliament and of the Council.
The Directive 98/8/EC commenced a review programme for the examination of the active substances of all biocidal products already on the market. Until the decision is made in the review programme concerning a certain active substance, in the "transition period", the placing of biocidal products* on the market is regulated by the Member States' own, national regulations in force. After the the decision on the inclusion of the given active substance is made, as a result of the review programme, the authorisation of the active substance is made according to the Directive and the joint ministerial decree of the Minister of Health, Social and Family Affairs, the Minister of Agriculture and Rural Development and the Minister of Environment and Water No 38 of (7 July) 2003.

*The definition of a biocidal product according to the joint ministerial decree of the Minister of Health, Social and Family Affairs, the Minister of Agriculture and Rural Development and the Minister of Environment and Water No 38 of (7 July) 2003 is: an active substance, or a preparation containing one or more active substances, put up in the form in which they are supplied to the user, intended to destroy, deter, render harmless, prevent the action of, or otherwise exert a controlling effect on any harmful biological organism by chemical or biological means, and can be classified as one of the product types given in Annex V.
The Tasks of the Department of Biocides:
- As a Rapporteur Member State participation in the review procedure of active substances. - Compilation of coordinated public health and toxicological reports in the course of the authorization and other related procedures of biocidal products, for the Office of the Chief Medical Officer. - In the transition period, according to the Article 30 and 31 of the joint ministerial decree of the Minister of Health, Social and Family Affairs, the Minister of Agriculture and Rural Development and the Minister of Environment and Water No 38 of 2003 (7 July) making expert opinions on the preparations in the product types concerned.
The Department participates in the following tasks:
– teaching and postgraduate training, – drafting of legaslations according to the scope of action of the Department, – taking part in the work of the European Commission Directorate-General Environment Directorate B- ENV.B.3. CA, SC and TM
